{"id":132,"date":"2003-01-15T15:07:50","date_gmt":"2003-01-15T23:07:50","guid":{"rendered":"http:\/\/glenandpaula.com\/archives\/2003\/01\/15\/stanford-law-prof-loses-supreme-court-case\/"},"modified":"2003-01-15T15:07:50","modified_gmt":"2003-01-15T23:07:50","slug":"stanford-law-prof-loses-supreme-court-case","status":"publish","type":"post","link":"https:\/\/glenandpaula.com\/wordpress\/archives\/2003\/01\/15\/stanford-law-prof-loses-supreme-court-case","title":{"rendered":"Stanford Law Prof Loses Supreme Court&nbsp;Case"},"content":{"rendered":"<p><a href=\"http:\/\/cyberlaw.stanford.edu\/lessig\/bio\/short\/\">Lawrence Lessig<\/a>, a Stanford law professor, just <a href=\"http:\/\/cyberlaw.stanford.edu\/lessig\/blog\/archives\/2003_01.shtml#000862\">lost his case in Supreme Court<\/a>.<\/p>\n<p>He was arguing that the Congress has overstepped its Constitutional authority through its abuse of the copyright system.<\/p>\n<p>As an editorial aside, I\u2019d like to say that I\u2019m pretty disappointed by the defeat. I\u2019m no expert in the law, but ministers are considered to have some expertise when it comes to morality (which ought to undergird the&nbsp;law).<\/p>\n<p>The laws governing copyright in our society are excessive. First and most importantly, we are losing a public domain. Lessig\u2019s (non-legal) arguments about the hypocrisy of Disney are very compelling\u2013Disney keeps its copyright on Mickey Mouse despite making most of its money off reinventing characters that have passed into the public domain (Beauty &amp; the Beast, Cinderella, Snow White, etc).<\/p>\n<p>But that just deals with the longevity of copyright in America. I also consider that my fair-use rights are being infringed upon by rigid copyright schemes. To my knowledge, every empirical study has shown that <b>electronic redistribution of products increases sales<\/b>.
