{"id":132,"date":"2003-01-15T15:07:50","date_gmt":"2003-01-15T23:07:50","guid":{"rendered":"http:\/\/glenandpaula.com\/archives\/2003\/01\/15\/stanford-law-prof-loses-supreme-court-case\/"},"modified":"2003-01-15T15:07:50","modified_gmt":"2003-01-15T23:07:50","slug":"stanford-law-prof-loses-supreme-court-case","status":"publish","type":"post","link":"https:\/\/glenandpaula.com\/wordpress\/archives\/2003\/01\/15\/stanford-law-prof-loses-supreme-court-case","title":{"rendered":"Stanford Law Prof Loses Supreme Court Case"},"content":{"rendered":"<p><a href=\"http:\/\/cyberlaw.stanford.edu\/lessig\/bio\/short\/\">Lawrence Lessig<\/a>, a Stan\u00adford law pro\u00adfes\u00adsor, just <a href=\"http:\/\/cyberlaw.stanford.edu\/lessig\/blog\/archives\/2003_01.shtml#000862\">lost his case in Supreme Court<\/a>.<\/p>\n<p>He was argu\u00ading that the Con\u00adgress has over\u00adstepped its Con\u00adsti\u00adtu\u00adtion\u00adal author\u00adi\u00adty through its abuse of the copy\u00adright sys\u00adtem.<\/p>\n<p>As an edi\u00adto\u00adr\u00adi\u00adal aside, I\u2019d like to say that I\u2019m pret\u00adty dis\u00adap\u00adpoint\u00aded by the defeat. I\u2019m no expert in the law, but min\u00adis\u00adters are con\u00adsid\u00adered to have some exper\u00adtise when it comes to moral\u00adi\u00adty (which ought to under\u00adgird the law).<\/p>\n<p>The laws gov\u00adern\u00ading copy\u00adright in our soci\u00adety are exces\u00adsive. First and most impor\u00adtant\u00adly, we are los\u00ading a pub\u00adlic domain. Lessig\u2019s (non-legal) argu\u00adments about the hypocrisy of Dis\u00adney are very compelling\u2013Disney keeps its copy\u00adright on Mick\u00adey Mouse despite mak\u00ading most of its mon\u00adey off rein\u00advent\u00ading char\u00adac\u00adters that have passed into the pub\u00adlic domain (Beau\u00adty &amp; the Beast, Cin\u00adderel\u00adla, Snow White, etc).<\/p>\n<p>But that just deals with the longevi\u00adty of copy\u00adright in Amer\u00adi\u00adca. I also con\u00adsid\u00ader that my fair-use rights are being infringed upon by rigid copy\u00adright schemes. To my knowl\u00adedge, every empir\u00adi\u00adcal study has shown that <b>elec\u00adtron\u00adic redis\u00adtri\u00adb\u00adu\u00adtion of prod\u00aducts increas\u00ades sales<\/b>.
