I\u2019m in the Stanford Review."},"content":{"rendered":"<p><a href=\"http:\/\/www.flickr.com\/photos\/35703177@N00\/3617981886\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/farm4.static.flickr.com\/3633\/3617981886_6c53a07eb8_m.jpg?w=840\" alt=\"Stephen Colbert in Iraq\" title=\"The interview was just like this... only not.\" hspace=\"5\" border=\"0\" class=\"right\"><\/a>I was recent\u00adly inter\u00adviewed by the Stan\u00adford Review (a stu\u00addent pub\u00adli\u00adca\u00adtion) for <a href=\"http:\/\/stanfordreview.org\/article\/supreme-court-student-groups-must-take-everyone\">an arti\u00adcle ana\u00adlyz\u00ading the Supreme Court\u2019s deci\u00adsion in CLS vs Mar\u00adtinez as it relates to Stan\u00adford<\/a> (a case I have <a href=\"http:\/\/glenandpaula.com\/wordpress\/archives\/2010\/06\/30\/freedom-of-association-at-public-universities\">pre\u00advi\u00adous\u00adly writ\u00adten about<\/a>). <\/p>\n<p>As is almost always the case with inter\u00adviews, I said way more than they had space to include in the final arti\u00adcle. Since the inter\u00adview was via email, I have the full text of my remarks avail\u00adable. I should note that <a href=\"http:\/\/stanfordreview.org\/article\/author\/aacarter\">Autumn Carter<\/a>, the inter\u00adview\u00ader, asked me sev\u00ader\u00adal ques\u00adtions I declined to answer.<\/p>\n<p>So here\u2019s what I had to say:<\/p>\n<blockquote><p>\n<b>SR: What is your opin\u00adion towards the Supreme Court\u2019s rul\u00ading in gen\u00ader\u00adal? With regard to Stan\u00adford?<\/b><\/p>\n<p>Me: The Supreme Court\u2019s log\u00adic would not apply at most pub\u00adlic uni\u00adver\u00adsi\u00adties since the case at UC Hast\u00adings is so unique, and it will have no direct impact at all on pri\u00advate uni\u00adver\u00adsi\u00adties such as Stan\u00adford. And I has\u00adten to point out that the case has been remand\u00aded back to a low\u00ader court for a clos\u00ader exam\u00adi\u00adna\u00adtion of some fac\u00adtu\u00adal issues. The Chris\u00adt\u00adian Legal Soci\u00adety alleges that UC Hast\u00adings enforced its poli\u00adcies unequal\u00adly and in a dis\u00adcrim\u00adi\u00adna\u00adto\u00adry man\u00adner, some\u00adthing which the Supreme Court believes mer\u00adits fur\u00adther inves\u00adti\u00adga\u00adtion.<\/p>\n<p>But to get bogged down in the legal maneu\u00adver\u00ading is to miss the essence of the case. For a uni\u00adver\u00adsi\u00adty to force a Chris\u00adt\u00adian min\u00adistry to accept lead\u00aders who do not share its beliefs is as absurd as Chi\u00adna\u2019s plan to choose the next Dalai Lama, and I would sus\u00adpect such a uni\u00adver\u00adsi\u00adty of hav\u00ading sim\u00adi\u00adlar motives: to con\u00adtrol and to under\u00admine reli\u00adgious belief which the author\u00adi\u00adties dis\u00adap\u00adprove of.<\/p>\n<p>Uni\u00adver\u00adsi\u00adties must decide what they believe tol\u00ader\u00adance looks like. Are they will\u00ading to become intol\u00ader\u00adant in the pur\u00adsuit of tol\u00ader\u00adance? Are they will\u00ading to achieve their goals through coer\u00adcion rather than rea\u00adsoned dis\u00adcourse? UC Hast\u00adings appears to have decid\u00aded that it is. It remains to be seen how many uni\u00adver\u00adsi\u00adties will embrace their fol\u00adly.<\/p>\n<p><b>SR: As you men\u00adtioned, Stan\u00adford is a pri\u00advate uni\u00adver\u00adsi\u00adty and is there\u00adfore unaf\u00adfect\u00aded by the rul\u00ading direct\u00adly. But do you antic\u00adi\u00adpate any moves by Stan\u00adford to tight\u00aden its own group mem\u00adber\u00adship pol\u00adi\u00adcy either inde\u00adpen\u00addent\u00adly or as a result of being lob\u00adbied? Or will Stan\u00adford like\u00adly main\u00adtain the loos\u00ader pol\u00adi\u00adcy that it cur\u00adrent\u00adly uses?<\/b><\/p>\n<p>Me: Should such lob\u00adby\u00ading arise I hope that Stan\u00adford will prove wis\u00ader than the Supreme Court.\n<\/p><\/blockquote>\n<p>In ret\u00adro\u00adspect, I\u2019m sur\u00adprised the Stan\u00adford Review chose the quote they did.
